In the case of Green Woods LLC v. Brian Kleiman, et al. Hamilton County Superior Court Judge William J. Hughes ordered the ordinance vacating the contested portions of Meridian and Davis (CR 100 S) Roads, "VACATED". This victory for the Plaintiff, Green Woods LLC, is a major achievement for the local land owner and their grass-roots supporters. Judge Hughes' order effectively prevents Eli Lilly & Co. from taking ownership of the nearly four miles of road the Hancock County Commissioners had vacated at the bequest of Lilly.

Evidently, The Roads are an important subject among community members even though they were cut-off and disallowed from speaking about infrastructure improvements at the meeting. Well now, looks like the Commissioner have their hands so full of litigation that their having to make special executive sessions [read: closed door] just to keep up with it all. At least Lilly's covering for the County on the road case. Hancock County recently unwrapped their new Internet site, Greenfield just launched their new portal and Lilly has redone their site as well...Looks like a redesign of this site may be in order. Beyond a doubt though, our hats go off to TheNetEffect.org for their timely, cutting-edge mega-portal connecting constituents AND candidates working to better local government through active participation.

Beyond the initial interest in seeing the new GIS site we were surprised to see the County release such detailed land records [including a highly detailed mapping system] on their new site. Now, after 9-11, with international terrorists apparently lurking around every corner these days, why haven't we heard a peep from Lilly? As professional benefactors of the fears in anything "unhealthy", they've sure blown their opportunity to thump their land-baron drums to the beat of Hancock County's impending doom from the glut of freely available information. Sheesh! Who needs roads wheen there's the Internet?!

The "Complaint to Set Aside Vacation Ordinance" by Greenwoods LLC, the owner of property along 100S east of Meridian was filed today in the Hancock Circuit Court .adverse the Commissioners of Hancock County and Hancock County and Eli Lilly and Company. Among the many allegations were that the Ordinance was a Violation of the Comprehensive Plan, there were fatal Description Errors, that there was Constructive (not real) Fraud in the adoption of the Ordinance in that it did not serve the public interest in enumerated ways and that the actions of the Commissioners were Arbitrary and Capricious in enumerated ways, and there was failure to obtain fiscal approval from the County Council of Hancock County.

“The last parts of the toxicology additional are complete – as is all of the new infrastructure,” said David O’Donnell manager of plant engineering, maintenance and utilities at Lilly’s Greenfield Labs. The company has invested $122 million in 300,000 square feet of new additions in Hancock County over the past several years, including some new research facilities. Some of that space already is in use. Several other facilities have yet to be completed, including a new facilities management building. O’Donnell said that building should be complete by next year.

Live! from the 'Insert-Foot-in-Mouth-Here' Department, Don Pearson of Greenfield Labs’ community relations department is quoted in the Indy Eye as saying: "We own the land on both sides of the road, therefore we technically own the road." Hey Don, if 'you' "own" the road then why ask the County for permission to close them?  Attention farmers: you've got land on boths sides of a road? Don's just shown you the way to join up your land and rid it of those pesky cars that get all jammed up behind your tractor.

The Commissioners have set the hearing for Tuesday, June 3, 2003 at 6:30pm in the meeting room of the Hancock County Plan Commission, 110 S. State Street (courthouse Annex 2, or old city hall).

The last 3 days has seen a dramatic rise in traffic at the Daily Reporter ePoll, with an uncharacteristic collection of votes in nearly exclusive favor of closing the roads. Nearly 500 votes were cast over a weekend spent honoring our mothers and dodging tornadoes. Who had the time to cast all those votes? Our conclusion: dubious numbers all around - nearly 600 votes have been cast since our original posting of our technical analysis.

The ePoll on the http://www.greenfieldreporter.com has displayed some uncharacteristic behavior recently. This evidently changed the results from over 50% of votes resoundly against closing the roads to 50% of votes resoundly for closing the roads within 1 hour by some observations. David Hill, editor of the Daily Reporter, stated the poll is "unscientific" and had "no basis" since they are unable to track who is voting. He continued, that while the poll had collected 129 votes in its first 8 days, within the last 48 hours he observed the poll had now collected over 450 votes - "you make your own conclusion". They will be removing the Poll from their web site soon. Further, our technical analysis of the ePoll indicates voting unlimited times is easily achieved by simply deleting and then blocking "cookies" from the http://www.greenfieldreporter.com site within MS IE or with free trial software such as Cookie Pal.
