The "Complaint to Set Aside Vacation Ordinance" by Greenwoods LLC, the owner of property along 100S east of Meridian was filed today in the Hancock Circuit Court .adverse the Commissioners of Hancock County and Hancock County and Eli Lilly and Company. Among the many allegations were that the Ordinance was a Violation of the Comprehensive Plan, there were fatal Description Errors, that there was Constructive (not real) Fraud in the adoption of the Ordinance in that it did not serve the public interest in enumerated ways and that the actions of the Commissioners were Arbitrary and Capricious in enumerated ways, and there was failure to obtain fiscal approval from the County Council of Hancock County.
