February, 2 2005 Dear Sir
At the road closing public hearing held on June 3, 2003 Commissioner Kleiman stated that he was going to allow Lilly one entrance onto their property and that any further communications after June 3rd would, only be, accepted in writing from either party. At the road closing trial, held in Hamilton County on January 31 to February 2, 2005, it was disclosed that our County Commissioners met with Lilly 26 times in private meetings and phone conversations. Even though Commissioner Kleiman had told the public on June 3, 2003 at the hearing the Commissioners would only accept communications in writing, it was also revealed that Commissioner Kleiman met with Lilly legal representative Ron Pritzke and had phone conversations numerous times after June 3, 2003 and before the June 9. 2003 vote. And, as if this flip-flopping wasn’t enough, despite the fact Kleiman told public at the June 3, 2003 hearing that there would be only one entrance, the amended agreement permits two entrances. These private calls concluded in an amended road closing agreement granting Lilly two entrances. Evidence presented at the trial suggested that Franklin Street could have a second entrance for trucks, contractors, and commercial traffic in and out of Lilly’s. To further compound the matter; CP Morgan is currently building 277 homes on Franklin Street, between Tague Street and Davis Road. Both of these streets are residential streets. It would be detrimental to the neighborhood to put such heavy commercial traffic on these streets. As residents and constituents, we deserve better than the run-down brand of old-school, broken politics our county was offered in exchange for the roads.
